Radicado proyecto de ley de participación ciudadana en asuntos mineros y petroleros

En la Cámara de Representantes, un total de 40 de congresistas de diferentes partidos políticos radicaron el proyecto de ley de democracia ambiental, con el que buscan que se regule el derecho a la participación ciudadana frente a proyectos de exploración y explotación de recursos naturales no renovables.

La iniciativa construida por más de 150 organizaciones de los departamentos de Atlántico, Antioquia, Bogotá, Bolívar, Boyacá, Caldas, Caquetá, Casanare, Cauca, Cundinamarca, Huila, Meta, Nariño, Quindío, Cesar, Risaralda, Santander y Tolima, surgió luego de que en el 2018 y mediante la sentencia SU-095, la Corte Constitucional ordenara al Congreso expedir una ley que garantice mecanismos de participación para que la ciudadanía se exprese frente a proyectos mineros y de hidrocarburos.Dicha orden tiene como origen la constatación que hizo el alto tribunal, de la inexistencia de mecanismos específicos para garantizar el derecho a la participación ciudadana en la legislación minera y de hidrocarburos. En palabras de la Corte, el hecho de que las leyes que regulan dichas industrias no garanticen ese derecho constituye un “déficit constitucionalmente inadmisible”.

“Hemos radicado este proyecto de ley que recibimos de las organizaciones ambientales para cumplir así lo ordenado por la Corte Constitucional, y ante las acciones del gobierno que sigue imponiendo proyectos extractivos sin promover espacios de participación efectivos de las comunidades que serían afectadas, y sin tener en cuenta las preocupaciones de los territorios”, manifestaron los congresistas coautores de la iniciativa.Desde el Movimiento Nacional Ambiental celebraron la radicación, señalando que el Congreso estaba en mora de discutir una propuesta legislativa que apunte en esa dirección.

“El diseño de los mecanismos de participación que reglamenta esta ley, contribuye a que la toma de decisiones no se oriente solamente por el potencial minero energético de los territorios, tal como sucede actualmente, sino por otros factores relevantes para la vida de las comunidades como los ambientales, económicos, sociales y culturales”, manifestó Robinson Mejía, integrante del Movimiento Nacional Ambiental.

Según los legisladores, las propuestas del proyecto de ley para garantizar esa participación retoman mecanismos ya existentes como el cabildo abierto y las audiencias públicas, pero adaptadas a las necesidades socioambientales de los territorios.

“Así, el proyecto desarrolla un cabildo abierto socioambiental y una audiencia pública de control socioambiental para garantizar la participación de la ciudadanía en distintas fases de estos proyectos, teniendo en cuenta si estamos frente a nuevos proyectos y proyectos en fase de exploración, explotación o cierre”, puntualizaron.
