Por presunta falta de ejecución del PAE, Procuraduría formuló cargos contra exalcalde de Maní
La Procuraduría General de la Nación formuló cargos contra el alcalde del municipio de Maní, Casanare (2016-2019), Tony Wilfred Ávila Hernández, por las presuntas irregularidades en la ejecución del Programa de Alimentación Escolar (PAE) durante la totalidad del calendario escolar 2016.
Al parecer, el exalcalde habría omitido la prestación del servicio del PAE para los estudiantes de la localidad, desde el primer día del calendario escolar y durante la vigencia 2016, a pesar de contar con recursos presupuestales disponibles por valor de $246’729.324.
Según el Ministerio Público, el investigado habría desconocido los derechos fundamentales a la educación, la asistencia y bienestar social de los niños, niñas y adolescentes de las instituciones educativas del municipio.
Asimismo, recordó que “el ordenador del gasto en su territorio debe adelantar los procesos de contratación del PAE necesarios para ejecutar en forma oportuna durante todo el calendario escolar vigente, los recursos destinados para tal fin”.
Para la Procuraduría se pudo vulnerar el principio de eficacia, en el entendido que a las autoridades administrativas les corresponde asegurar la protección infantil y el suministro de la nutrición balanceada durante toda la jornada escolar, contribuyendo a garantizar sus derechos a la educación y alimentación.
La posible falta de Ávila Hernández se calificó provisionalmente como grave a título de culpa gravísima, por la supuesta falta de compromiso del entonces mandatario con la población adolescente y joven del municipio.
La Procuraduría Regional de Casanare precisó que, terminada la etapa de instrucción, el expediente se remitirá por competencia a la Procuraduría Delegada para el Juzgamiento Disciplinario (reparto), ante la cual los sujetos procesales podrán presentar descargos, versión libre, y aportar y/o solicitar pruebas y sus alegatos, si lo estiman pertinente.
