La Fiscalía General de la Nación demostró en juicio oral que Yhonier Rodolfo Leal Hernández es el responsable del crimen de su mamá, la señora Marleny Hernández; y de su hermano, el estilista Mauricio Leal Hernández, ocurrido entre el 21 y 22 de noviembre de 2021, en un inmueble del vecino municipio de La Calera, Cundinamarca.
En ese sentido, una juez penal de conocimiento de Bogotá lo condenó a 55 años y 3 meses de prisión, por los delitos de homicidio agravado; y ocultamiento, destrucción o alteración de elemento material probatorio. Además, le impuso una multa equivalente a 250 salarios mínimos legales mensuales vigentes.
Las pruebas recopiladas acreditaron que Leal Hernández le proporcionó a su hermano nueve pastillas de un medicamento para dormir, una sobredosis que lo puso en estado de indefensión. Posteriormente, se dirigió a la habitación de su mamá y la atacó con un cuchillo mientras dormía. Con la misma intención se dirigió a la alcoba del reconocido estilista y le propinó varias heridas con dos objetos cortopunzantes distintos.
Antes de la agresión y, aprovechando la condición de debilidad en la que estaba Mauricio Leal, lo obligó a escribir una nota en la que indicaba que había asesinado a su señora madre y anticipaba que se quitaría la vida. Asimismo, tomó el celular de la víctima y grabó varias notas de voz haciéndose pasar por ella e indicándole al conductor que no se acercara a recogerlo porque quería descansar.
La Fiscalía, a través de técnicas forenses, obtuvo suficiente evidencia para establecer que Yhonier Leal fue la única persona que estuvo en el inmueble durante el espacio temporal en el que ocurrió el doble crimen. También encontró rastros de sangre en distintos sitios de la vivienda y otros elementos que dan cuenta de su autoría.
