Un importante fallo a favor del municipio de Yopal, logró el equipo de Defensa Judicial, adscritos a la Oficina Asesora Jurídica. Este fallo proviene de una demanda de reparación directa, que resolvió el Consejo de Estado en una segunda instancia, confirmando así, el primer fallo, emitido por el Tribunal Administrativo de Cundinamarca.
Esta demanda interpuesta en el año 2013, tenía como objetivo establecer la responsabilidad extracontractual del Estado, relacionada con el predio denominado “Yopitos”, el cual estaba siendo reclamado por un particular con escrituras públicas del año 1924, alegando que, este predio había sido indebidamente tratado como bien baldío por parte del municipio y por haber sido cedido en el año 2011 al Ministerio de Defensa Nacional para ser utilizado como infraestructura militar, demanda que en sus pretensiones económicas alcanzaba más de 15 mil millones de pesos para la época y que con la actualización monetaria alcanzaría alrededor de los 27 mil millones de pesos.
El Consejo de Estado determinó, gracias a la estrategia jurídica y judicial del municipio, que el bien fue tratado de la debida forma por la administración sin afectar intereses particulares antijurídicamente.
Es de resaltar que, con este tipo de fallos, la Oficina Asesora Jurídica, le ha ahorrado al municipio una cifra significativa de recursos económicos, gracias a una correcta estrategia de defensa judicial, que de forma constante se viene fortaleciendo, a través de retroalimentaciones periódicas de las sentencias más significativas, y garantizando la continuidad de la línea de defensa.
