La Fiscalía de Colombia rechazó este viernes la solicitud de libertad presentada por la defensa del expresidente, Álvaro Uribe Vélez, quien se encuentra bajo el estatus de detención domiciliaria por estar acusado de supuesto soborno de testigos y fraude procesal.
«El fiscal a cargo de la investigación rechazó la solicitud de libertad presentada por la defensa técnica del exsenador Álvaro Uribe Vélez porque ese tipo de peticiones solamente deben ser conocidas y decididas en audiencias preliminares por un juez de control de garantías», señaló la Fiscalía en un comunicado.
De acuerdo con el texto emitido por el ente judicial, el proceso del expresidente Uribe fue asignado este jueves al fiscal especial Gabriel Jaimes Durán, luego que la Corte Suprema de Justicia asignara el caso a la Fiscalía General de la Nación.
Precisamente, el fiscal Jaimes Durán justificó la negación de la petición porque el caso de Uribe se procesa desde el nuevo sistema penal en el que le corresponde a los jueces y no los fiscales tomar ese tipo de decisiones referente a la libertad de las personas.
En el documento oficial emitido la Fiscalía señaló que luego de la primera revisión del expediente se decidió llevarlo por la Ley 906 de 2004 o nuevo sistema penal acusatorio, ya que los hechos investigados ocurrieron entre 2016 y 2017.
La referida ley dispone un sistema en el que hay un fiscal que investiga, un juez de control de garantías que toma decisiones y un juez de conocimiento que es el que dirige el eventual juicio.
«La complejidad de la investigación y la dispendiosa documentación del expediente, exigirá que en los próximos días se haga un estudio del caso para definir un método de tránsito entre los dos sistemas procesales», expresa el comunicado.
