Mediante sentencia de unificación, Sala Plena Contenciosa mantiene elección del gobernador de Boyacá

La Sala Plena de lo Contencioso Administrativo dictó en el día de hoy fallo de única instancia en el proceso de nulidad electoral seguido contra el acto de elección del señor Ramiro Barragán Adame como gobernador del departamento de Boyacá y unificó la jurisprudencia en torno del alcance de la expresión “quienes sean designados en su reemplazo”, consagrada en el inciso único del artículo 31 de la Ley 617 del 2000.

La referida instancia judicial reconoció que, en pronunciamientos dictados por las secciones Primera y Quinta y la Sala Plena Contenciosa Administrativa, se presentaba una divergencia interpretativa respecto de los destinatarios de la incompatibilidad que se convertía en una inhabilidad, específicamente, en la determinación de la condición de reemplazante del gobernador y, por ello, la Sala Plena unificó la jurisprudencia.

Luego de efectuar un análisis literal y sistemático de las disposiciones de orden constitucional y legal aplicables, se fijó como regla de interpretación unificada, que los destinatarios de la norma señalada serán los siguientes: (i) los gobernadores elegidos democráticamente, trátese de elecciones típicas o atípicas; así como (ii) “quienes sean designados en su reemplazo”, entendiendo que ellos son los designados por el presidente de la República, en los casos en que se presenta falta absoluta del titular bajo los eventos descritos en el inciso 3º del artículo 303 de la Constitución.

Frente al segundo evento, se consideró que la expresión “reemplazo” implica necesariamente un cambio en la titularidad del cargo, lo que permite señalar que situaciones administrativas como el encargo de funciones no tienen la entidad suficiente para entender que el sujeto de esta adquiere la calidad de reemplazante del gobernador. Se destaca de las razones expuestas en la decisión judicial, que la interpretación efectuada en tal sentido permite conservar la finalidad y el efecto útil del régimen constitucional y legal de inhabilidades aplicable a quienes pretenden aspirar a dicha dignidad.

Con fundamento en lo dicho, se negaron las pretensiones de la demanda de nulidad electoral presentadas contra el acto acusado.

Se señaló que el encargo del cual había sido objeto el demandado cuando tuvo la calidad de secretario general del departamento de Boyacá, no fue de aquellos efectuados por el presidente de la República. Por el contrario, se comprobó que fue una decisión adoptada por el gobernador de la época -período constitucional 2016-2019-, señor Carlos Andrés Amaya, con fundamento en la posibilidad que para el efecto consagra el artículo 93 del Decreto Ley 1222 de 1986, que habilita a dejar encargado del despacho para asuntos urgentes a uno de los secretarios, cuando el primer mandatario departamental debe ausentarse de la residencia habitual para ejercer sus funciones por fuera de ella.
